| 宪政需要是公民、国家对政治形态的宪政特征、功能的认知而产生的一种期待,宪政需要是法律需要的下位概念,法律需要是宪政需要的逻辑前提。宪政需要具有层次性,由低向高分为三个层次:宪政权利需要、宪政规范需要及宪政秩序需要。结合中国宪政实际,按照宪政需要规律,提出宪政需要层次论,完善宪政需要层次结构的相应对策,以此来维护公民的宪政需要,推进国家的宪政建设。 |

| Constitutionalism needs are an expectation resulted from both the citizens’ and the state’s cognitions on constitutionalism characteristics and functions of political ideology.Constitutionalism needs are the hypostasis concept of legal needs,of which is the logical premise.Constitutionalism needs are of high hierarchy,with three hierarchies from low to high,i.e.constitutionalism needs of rights,constitutionalism normative needs,and constitutionalism needs of order.Combining the reality of the China’s constitutionalism with the laws of constitutionalism needs,this paper puts forward the hierarchy theory of constitutionalism needs,and improves the corresponding measures of the hierarchical structure of constitutionalism needs,so as to maintain the civil constitutionalism needs and advance the construction of the country’s constitutionalism needs. |
