| 人格权作为主体对自身的支配权,是人的所有民事权利中最重要的权利。随着人类文明程度的提高及现代科技、大众传媒等的发展、普及,人格权也呈现出一些新的发展。人格权主体不断扩张,表现为人格权主体向胎儿、死者的扩张及人格权边缘主体的出现;信用权、声音权、精神安宁权等新型人格权不断涌现;法律开始承认肖像权、姓名权等一部分自然人人格权中的经济利益内涵,人格权中的经济利益不断凸显;对权利人基于自身人格所享有的利益受到的不法侵害,人格权侵权救济的方式不断丰富。 |

| Being their own control over the subject,personality rights are all the most important civil rights of human rights With the increased level of human civilization and the popularity of modern technology and mass media,personality rights system also presents some new developments.Personality right show the continuous expansion of the main trends in the performance of the main body to the fetus as personality rights,the deceased’s rights to the edge of the main expansion and the emergence of personality rights;There emerge new types of personality rights,such as credit rights,sound of rights,the rights of spirit peace;Law starts to recognize the rights of portrait,name and other personality rights of individuals as part of the economic interests of content,and the personality rights are paid more and more attention to in the economic interests;rights enjoyed by the people based on their personal interests are violated,and the relief ways of infringed personality rights are continuously enriched. |
