| 高校章程是现代大学治理和自治的基础,而目前在我国的高校中,章程基本上处于缺位或者虚设的状态。高校法人地位不明确、行政职能泛化、学术权力弱化等等倾向,反映了高校管理体制和治理结构中较为普遍的行政化特征和权力本位色彩,制约了我国高等教育功能更好地发挥,与构建适应中国国情并与国际接轨的现代大学制度不相适应。因此,重构政府管理权力与高校办学自主权,理顺高校内部的法人治理,作为依法治校制度基础的高校章程不可或缺。"章程之治"之下,我国高校行政化的痼疾或可改观。 |

| Currently,university charters are basically vacant or nominal in the universities of China,although they serve as a basis of administration and self-governance of modern universities.In the administrative system and the governance mechanism of a university,the common characteristics of administrative control and power standard grow out of the tendencies,such as a blurred legal entity of university,abused administrative functions and weakened academic authority.They restrict the proper functions of the higher education,and are entirely incompatible with modern university system which conforms to the situation in China and keeps in line with international standards.Therefore,charters play an indispensable and fundamental role in managing a university by law in order that the government’s supervision would be reformed,the university self-governance would be reinstated and the corporate governance would be straightened out inside the university."Operation in accordance with charters" might cure the chronic malady of administration-controlled universities. |
