| 信赖保护原则是当今法治国家公法中公认的一项基本原则,其现实基础在于人民对政府的信赖。信赖保护原则传统理论依据有诚信原则说、法安定性说和基本权利保障说三种,其实它们并不能真正反映出信赖保护原则的核心价值理念。故此,以法治主义为核心基础的信赖保护原则理论依据得以重构。 |

| Trust Protection Principle,which realistic basis comes from governmental credit standing,has been generally acknowledged as an important thesis in countries ruled by law.The traditionally theoretical foundation of Trust Protection Principle lies in Good Faith,Stability of Law,and Protection of Basic Rights.This paper introduces and criticizes traditional theories about the Trust Protection Principle,and tries to put forward a theoretical foundation based on Rule of Law. |
