| 转售价格维持作为一种纵向价格限制，其对消费者福利和社会总福利的影响目前无法用经济理论得到一个标准的答案。在美国，司法机构采用的是本身违法规则和合理规则的二分法模式。欧共体在此问题上采用的是一种原则性的禁止规定与责任豁免例外相结合的立法体例，并通过发布指南明确规定了豁免的类型和条件。在我国的转售价格维持案件中，反垄断执法机构的论证过程存在违法性标准不明、缺乏明示的证据规则等问题。 |

| As a typical vertical restraint agreement, the effect of resale price maintenance on consumer welfare and social welfare of the current economic theory cannot get a standard answer.Regarding the regulation of RPM, U.S uses the dichotomy of the per se rule and rule of reason. European countries have developed a new legislative institution which combines prohibition with exemption, as well as guidelines regulating the type and condition of exemption. In Chinas resale price maintenance cases, the antimonopoly enforcement authority has the difficult to determine the standard of illegality and is lack of explicit rules of evidence |
