Abstract:Although a special chapter in Property Law regulates the use right of housing land,establishes the usufructuary right nature of the use right to the rural housing land and ends the academic controversies over the nature of use right to housing land;However,the relevant aspects of the transfer system of use right to housing land are imperfect and impractical.For example,the regulation on the transfer object is too strict;transfer rules of use right of housing land are faulty;notification system of the real estate property is lacked;the registration procedure is imperfect,and so on.Based on the analysis of property rights system of rural housing land,the problems arising in the practice of the housing land transfer and the legislative situation,this paper puts forward a proposal on improving the transfer system of the use right to housing land,which will not only protect the use right of farmers’ housing land,but also promote the full use of it.
