Constitutionalism needs are an expectation resulted from both the citizens’ and the state’s cognitions on constitutionalism characteristics and functions of political ideology.Constitutionalism needs are the hypostasis concept of legal needs,of which is the logical premise.Constitutionalism needs are of high hierarchy,with three hierarchies from low to high,i.e.constitutionalism needs of rights,constitutionalism normative needs,and constitutionalism needs of order.Combining the reality of the China’s constitutionalism with the laws of constitutionalism needs,this paper puts forward the hierarchy theory of constitutionalism needs,and improves the corresponding measures of the hierarchical structure of constitutionalism needs,so as to maintain the civil constitutionalism needs and advance the construction of the country’s constitutionalism needs.
