The criminal record system in China’s criminal law has much influence on the offenders, particularly on juvenile offenders. It has all kinds of statutory and non-statutory effects and plays a negative role on the offender’s remorse and reform. However,up till now,the criminal law in China has not established abolition system of criminal record in China’s criminal law.The reasons for it lie in the Chinese historic and cultural tradition, especially in Chinese tradition of "humiliation crime",which has still remained alive today.Article 19 of The Amendment Act(VIII) to the Criminal Law of the People’s Republic of China confirms the exemption system of juveniles’ reporting criminal record.Article 95 of the latest Amendment Act to The Criminal Procedure Law proposes that the juvenile’s minor offenses shall be sealed up for safekeeping by judicial organs and the departments concerned. This paper suggests that China should avail itself of this opportunity to further establish juvenile’s abolition system of criminal record.
