Abstract:Originated from the University Autonomy Theory and the Special Power Relation Theory, the right of higher education management is to implement college personnel training, scientific research and social services. College students marriage and childbearing rights refer to that college students are legally entitled to love, marriage and child bearing. It is a result of the joint development of the Theory of Fundamental Rights and Principle of Party Autonomy. With the cancellation of the ban on college students marriage and childbearing, the conflicts between the two are gradually revealed. Only by introducing the rule of law in managerial idea, perfecting marriage and childrearing regulations in management system, strengthening collaborative governing in management mode, and adhering to the principle of limited intervention in the management and supervision, can balance the conflicts between the two and promote the harmonious development and healthy growth of university students.
