| 两型社会试验区是用后现代的理念实现现代化的追求,在世界历史上都缺乏现实的蓝本。基于法律与社会发展的一般理论,法治建设对两型社会试验区成败至关重要。从法哲学的角度思考两型社会试验区的法治发展,是具体的法治化实践展开的前提。这种思考主要从4个方面展开,并作出建议方案:法治模式宜借鉴外域自主创新,法治观念宜取功利主义,法治精神宜确立自由、平等、民主,法治评价宜确立宪政标准。 |

| "A Resource-Conserving and Environment-Friendly Society" experiment area tries to realize modernization by using the concept of post-modernism.It is a practice without any blueprint in the world.Theories about law and social development have certified that legal construction is crucial to success or failure.The precondition for the practice of the rule of law is philosophy law thinking.This thinking mainly lies in four aspects: the rule of law should be reference for the foreign model,the idea of rule of law should choose the theory of utilitarianism,the spirits of law should include freedom,equality and democracy,and evaluation of the rule of law should establish the constitutionalism standard. |
