| 现行逮捕证明标准存在诸多方面的不足;可考虑对逮捕证明标准作以下改进,把刑法规定的犯罪分为可捕罪与一般犯罪,可捕罪逮捕证明标准为"合理相信",指有充足证据使人合理相信犯罪嫌疑人涉嫌应捕罪;一般犯罪的逮捕证明标准为"犯罪暂时真实",且能绝对优势证明可能判处有期徒刑以上刑罚并有逮捕必要。 |

| There are many flaws in current criterion of proof for arrest.The criterion of proof for arrest can be considered for the following improvements.The crime under the Penal Code is divided into arrestable offence and general crime.Arrestable offence of standard proof is "reasonably belief ",which means that there are sufficient evidences for people to believe that the suspects should be arrested.The criterion of proof for general crime is "crime being real",and it means that the crimes should be punishable by prison sentence and should be arrested more than necessary. |
